HOA Painting Resolution July 2024
During a recent monthly SPHOA meeting, an owner appealed to the Board for permission to paint the exterior of their house due to their maintenance and repair concerns. This owner also suggested that the Board consider turning over responsibility for painting of the exterior of homes to the owners
The Board has reviewed the Association Documents and has concluded that the Documents do not allow for this transfer of responsibility. One approach to address this house painting issue is for the Board to develop and approve a policy and schedule to paint all the houses in the development at the same time at the Board’s direction.
After discussion and review, the Board has decided and will begin planning to have the entire community painted the second half of 2025 and every seven (7) years thereafter. This painting would be performed by the Association and the cost of the painting is an Association common expense paid for through an association-wide assessment to all owners.
Should an owner feel the need to paint their home outside of this established schedule, they can submit an application to the board requesting permission to do so from the Board. If permission is granted, the owner is responsible for procuring a properly licensed contractor and supervising the work, including any required inspections. The Board will specify the paint color and other technical aspects of the work and of the material to be used. The Owner shall provide to the Board the name of the Contractor and a copy of the painting contract showing that the painting specifications are in compliance with the Board’s specifications. The Board will obtain the owner’s sign-off on the project before the work can proceed. Painting by the Owner is done at the Owner’s expense. The owner will still be responsible for subsequent Assessments for all community painting scheduled by the Board.
Recognizing that the community was last painted in 2008 and there may be some owners who feel it necessary to paint their buildings prior to the community wide painting in 2025 the Board is allowing Owners a one time opt out of the 2025 community wide painting and undertake the painting of their building themselves. An Owner who chooses to opt out must submit an application for approval to undertake the painting of his/her building, procure a properly licensed contractor and supervise the work, including any required inspections. The Owner shall provide to the Board the name of the Contractor and a copy of the painting contract showing that the painting specifications are in compliance with the Board’s specifications. The Owner will be responsible for all costs of the painting and the Owner’s property will be excluded from the 2025 community painting cycle. Owners who choose to opt out will not be charged with the Assessment for the 2025 painting. To successfully opt out, the painting of the building must be completed by August 31, 2025. If the painting is not completed by August 31, 2025, then the building will be included in the community wide painting and the Owner will be responsible for the Assessment levied for the community wide painting.
To the extent any Owner has painted their building in the last 18 months with prior approval from the Board, such Owner may also opt out of the 2025 community wide painting.
